PCADV signed on as an Amicus on a brief authored by the Women’s Law Project in a federal case before the Third Circuit Court of Appeals named Hall v. Millersville. The suit filed by the parents of Karlie Hall, a victim of dating violence against Millersville University, alleged that the University failed to meet its obligations under Title IX in failing to respond to Ms. Hall’s reported dating violence.
The federal district court ruled in favor of Millersville on a motion for summary judgment and the Hall’s appealed.
The main issue for the court to decide was whether Millersville had actual knowledge that Ms. Hall was a victim of dating violence and, therefore, if they were liable under Title IX.
In a unanimous opinion by a three-judge panel, the Third Circuit ruled in favor of Ms. Hall’s parents and estate and found that Millersville had actual notice of the dating violence at issue, and that the Hall’s suit, as to whether Millersville reacted with “deliberate indifference” in failing to respond to said dating violence, could move forward.
