Insurance DiscriminationPennsylvania law does not allow insurance companies to deny coverage or benefits to victims of domestic violence for life, health, disability, homeowners and auto insurance. This protection came about as the result of more than 12 years of advocacy with the insurance industry and policy leaders on the part of PCADV and the Womens Law Project of Philadelphia. 1n 1996, PCADV and the Womens Law Project were successful in efforts to enact Act 24, amendments to Pennsylvanias Unfair Insurance Practices Statute, to address discrimination against victims of domestic violence in life, health and disability insurance matters. Subsequently, in 2006, PCADV succeeded in further amending the Unfair Insurance Practices Statute through Act 78 to address discrimination against victims of domestic violence in property and casualty insurance (homeowners and auto). To date, 41 states have adopted some form of legislation prohibiting insurance discrimination against victims of domestic violence. PCADV continues to work with advocates across the country for a federal remedy to ensure comprehensive and uniform protections.
